Notices and warrants

Defective notices, warrants and service problems

Wrong addresses, stale details, missing notices and defective warrants can change the route completely. The documents need to be checked in order.

Notices and warrants

Start with the authority, the deadline and the evidence.

Civil enforcement problems often look dramatic, but the legal route usually depends on the papers: who the debt is against, what authority is relied on, what notices were served, what goods were controlled or removed and what evidence proves loss or ownership.

Documents to send

  • The warrant, writ, liability order or notice relied on.
  • Address history and proof of residence.
  • All letters, notices and emails received.
  • Court, council, creditor or enforcement reference numbers.
  • Proof of when and where documents were received.

What can be prepared

  • Service and address chronology.
  • Notice defect issue list.
  • Document request list.
  • Draft complaint, response or route note where appropriate.
  • Bundle for solicitor, counsel or adviser.

Questions people ask

Before action is taken

What should I send first?

Send the latest notice, warrant, writ, attendance record, clamp/removal paperwork, deadline and anything proving ownership, payment, vulnerability or loss.

Can this be urgent?

Yes. If there is a sale, removal, deadline, hearing or imminent visit, put that date at the start of the message.

Do you file documents for me?

Jason prepares documents and case materials. The client remains responsible for filing documents at court and serving other parties unless an authorised legal professional is separately instructed.

Next step

Lead with the enforcement date.

If a vehicle, goods, sale, visit, writ or warrant is involved, send the latest paperwork and the date first.
